TMC Auto Repair LLC agrees to the selected warranty below for the customer over the vehicle listed below with the pursuant of the set forth below: 1. WARRANTY CHOICES. Customer and Repair Facility agrees to the following type of warranty placed onto the vehicle. (Circle one choice below.) NO WARRANTY (Customer agrees that the Repair Facility will not warranty any and all repairs done on the vehicle. Sections 2 - Section 6 do not apply to this choice.) 30 DAY 90 DAY 6 MONTH 1 YEAR 2. WARRANTY CONDITIONS. Customer agrees to properly maintain the parts or system warrantied. Receipts and invoices are required for proof of regular maintenance and service intervals for the warrantied part/system. Customer agrees to cover the costs of parts that are not warrantied but may be required for proper vehicle function. Customer agrees that warranty work is only covered at Repair Facility and by a Repairer authorized by Repair Facility. Additional Conditions: 3. ITEMS NOT COVERED BY WARRANTY. Customer agrees that warranty does not cover any malfunctions or damages of warrantied part/system that occur due to a collision, natural disaster, vandalism, or any event that is not because of the warrantied part/system failure. Customer agrees that warranty does not cover any diagnostic or repair costs conducted by another business for the warrantied part/system. 4. GROUNDS TO VOID WARRANTY. Customer agrees that Repair Facility can void entire warranty if the vehicle is not properly maintained and/or cannot show appropriate proof of regular maintenance and service intervals. Customer agrees that Repair Facility can void entire warranty if the vehicle is taken to a different repair facility without notification. Warranty is void if ownership of vehicle is transferred and not approved by Repair Facility. 5. AUTHORIZATION. Customer expressly represents and warrants that Customer has the lawful right to authorize warranty repairs to be made to the Vehicle; whether by right of ownership, leasehold interest, or direct authorization from the owner of the Vehicle. Customer authorizes Repair Facility to conduct warranty work on Vehicle and further authorizes Repair Facility to move, test drive, or otherwise operate the Vehicle for purposes of repairing the Vehicle and determining its functionality. 6. REPAIR FACILITY RESPONSIBILITIES. Customer agrees that Repair Facility is not responsible for repairing pre-existing issues or damages not stated on the invoice during the warranty work. Customer agrees that Repair Facility is not responsible for any mechanical issues, electrical issues, interior damage, exterior damage and any other problems that occur after release of the Vehicle and are unrelated to the warranty work made by the Repair Facility. If warranty work made by the Repair Facility involves a component of the electrical system (not entire) and an issue involving the electrical system occurs after release of the Vehicle that does not exclusively involve the electrical component repaired by the Repair Facility, then the Repair Facility is not responsible for the issue. 7. GOVERNING LAW AND VENUE. This agreement shall be governed by, construed, and enforced in accordance with the laws of the state of Arizona. Any action for the breach or enforcement of this action shall be brought exclusively in a court in Maricopa County, Arizona.
